General conditions of sale PROTOXIDE
Please read these conditions of sale and delivery carefully. Only those written in Italian are to be considered valid, as the other conditions of sale written in other languages are only to aid understanding and are the result of translations and may be incorrect or out of date.
In general:
These conditions of sale are the only ones recognized by PROTOXIDE di Tiziano Perfetti (hereinafter PROTOXIDE), for all commercial transactions, except for specific written conditions, agreed by us for exceptional reasons.
1-Prices:
All prices indicated by us are per unit, ex our point of sale and in Euro currency. The prices indicated in written offers, sent by post, newsletter, e-mail or fax, have limited validity. PROTOXIDE reserves the right in any case to revise the prices communicated or shown, following a change due to supply problems or fluctuations in official exchange rates or currency exchange rates, in any case giving notice to the customer, who has the right to cancel the order, without any penalty.
2-Orders:
Orders can be placed by phone, fax or email or by using our online shop.
Orders must clearly indicate the name or company name of the person placing the order, tax code or VAT number, telephone number and postal address, plus any special delivery methods, desired delivery date and preferred carrier and must obviously all be truthful. Incomplete orders will not be taken into consideration.
PROTOXIDE reserves the right to request order confirmation, with a deposit or advance payment for the material, depending on the product ordered. We advise that any cash on delivery shipments not collected will cancel the possibility of ordering again, as failure to pay for a cash on delivery shipment entails charges to have the shipment returned to our office and our system automatically inserts the customer into the "black list". For this reason there will no longer be any way to place future orders, not even with advance payment.
Order confirmations requested by the customer are not binding if the materials ordered are not in stock.
The minimum order quantities are binding and are indicated in any offers and order confirmations. In the absence of indications, the minimum quantity is understood to be the single piece for stock materials and the linear metre for cables, sleeves, pipes and similar.
3-Delivery and order fulfillment:
Delivery will be made according to the methods agreed upon at the time of ordering. In the absence of agreements, we will proceed with the shipment according to the methods we deem most suitable.
Orders will be processed as soon as possible. In the event of temporary unavailability of some items, we reserve the right to delay delivery until the material is available. If the wait is too long, we will inform the Customer, who can decide in the meantime to send the available goods. In the event that some order items are no longer available due to obsolescence or discontinued production, we reserve the right to consider the orders processed. We also remind you that all orders are entrusted to couriers and PROTOXIDE is not responsible for any damage, delays in delivery or loss of material, therefore the goods travel at the risk and expense of the recipient/customer. The delivery times indicated in the products are for indicative purposes only, for this reason they may not be correct due to direct sales in the store and out-of-date warehouse stocks, for this reason the times indicated MUST NOT BE ABSOLUTELY BINDING, nor for this reason can the arrival date be guaranteed under any circumstances.
4-Defective materials, incorrect delivery and damages:
The customer is required to check the goods upon delivery. The customer has 14 days to make a complaint for defects in the origin of the goods or for incorrect delivery, missing goods inside the package, after which the goods will be considered accepted and no further consideration will be given to any and all complaints.
In case of acceptance of the complaint by our sales office, the return of the goods must be agreed with our "shipping and returns department" . PROTOXIDE will provide the replacement as soon as possible.
For goods ordered incorrectly, the same conditions apply, except for transport, which must be carriage paid.
If the customer does not accept the replacement, a credit note will be issued.
In the event of damage to the goods due to transport, the customer is required to immediately notify the carrier (write the wording damaged package in the appropriate field).
Protoxide is not responsible for damages due to the transport of goods even if carried out by couriers chosen by us.
5-Right of withdrawal and refusal of ordered goods, Returns:
As provided for by the current European legislation regarding mail order sales, the private customer (not a VAT holder) but also the company itself that makes a purchase by mail order has the right to withdraw from the purchase within 14 (fourteen) days from the day of receipt of the goods, giving timely written notice, via registered mail, email or PEC. In the event of a return, the costs of returning the goods are always borne by the buyer. The customer has the right by law to return the goods intact, NEVER INSTALLED. Please remember that the material must be in the condition as received so they must be in the usual new conditions, packaging included, never previously installed and even more so for electronic parts. (It must be like new in order to be able to resell it to a new customer clearly as new, and not as used or used only once or tried to be installed).
An exception to this is the case in which the customer or company decides to order by choosing a product that is not available at the time of ordering , easily identifiable as it does not have the wording next to the photo, USUALLY SHIPPED WITHIN 24 HOURS or in any case requires the piece to be made as it is not available in stock , the customer enters into an " exclusive " commitment with ProtoXide, therefore if the customer subsequently decides to cancel the order for any reason, or once received wants to return it for any reason, there can be no term for refusing the goods, or for returning them, as the goods have been handcrafted and made to your specific request, under the specific instructions and needs requested.
Returns must be "mandatory" sent back within and no later than 14 days of receiving the goods, and agreed in advance with Protoxide even with a simple email, it is always better to call, otherwise they will absolutely not be accepted and will be returned to the sender.
After 14 days, no replacement is possible and it is therefore mandatory not to send packages back without our confirmation and RMA number (useful in case of problems or repairs) which must be requested in advance MANDATORY via email or telephone.
Goods that are returned as a return from a foreign country where the customer later decides not to even collect the goods from customs after requesting the cost of customs clearance, will have costs that will still have to be borne to return the package and will be deducted from the refund.

6-Warranty:
PROTOXIDE distributes and sells the components described in the invoice for use in vehicles and/or engines designed and built by persons not associated and/or controlled by Protoxide. Therefore, a specific use of the same is not recommended or contemplated since the conditions of use of such components could create on the same or on other parts very severe stresses or problems beyond any possible prediction. Protoxide distributes and sells these products without any commercial or technical guarantee and therefore no type of express or implicit guarantee accompanies these products and the buyer and/or user, having checked these components, is the only one to decide how and where to use them in the application of his design, assuming with the installation of these components all the risks, as well as, possible and eventual lost profits or sales, losses, costs of substitute goods or services, interruptions of activity, damage to things or people or animals or any direct, indirect, incidental, patrimonial damages, which may derive from them, therefore Protoxide does not accept any type of charge due to defects in the materials delivered or related workmanship performed to install our components.
We remind you that ALL our products are to be used exclusively on racing vehicles and where the regulations allow them, therefore they are not approved for road use and absolutely must not be installed to replace original parts on road vehicles, as the only prerogative and objective of our products is exclusively to provide better "performances" to the detriment of everything else, such as reduced duration, greater noise, greater vibrations, greater consumption, etc., therefore the customer accepts it in full.
The customer assumes the responsibility of verifying the applicability of the purchased product referred to the use to the application he will use it, in case there is a defect from new the customer must report it to us immediately, before installing it, not after having installed it so that we can fix it or replace it, in the shortest time possible, receiving it back first to verify what has been supported. Therefore in these cases we can always replace but it is not possible to claim anything as a possible cost such as lack of use, disassembly and reassembly due to, or other costs incurred accessories as a fundamental preparation and knowledge is necessary that only the installer / preparer / workshop must possess, and for this we advise you
The materials found on the market on behalf of the customer, ( those not present in our online catalogue and requested under your indication) are supplied without any guarantee and are supplied as they are and no complaints are accepted on the quality of these components. (oxidation, lack of documentation, lack of packaging, finishing, etc.)
Materials sent to manufacturers or service providers for repairs, treatments, or replacements under warranty ALWAYS travel at the customer's risk and expense.
Protoxide products are mostly recognizable by silkscreened writings on them or by labels or on the packages themselves. The alteration or removal of such writings or logos, by the dealer/user, will result in Protoxide not recognizing them in the event of assistance, warranty, repair or other problems encountered.
7-Availability:
The availability of materials is subject to sales, excluding holidays and excluding unforeseen events, unless otherwise indicated in the offer or in the order confirmation.
8-Payments:
Payment methods are defined before the delivery of the material. Generally, advance bank transfer, credit card transaction or Paypal are preferred. In addition, for amounts less than 990 euros, it is possible to request payment on delivery by express courier, to be paid exclusively in cash, as the courier does not accept checks. In any case, before order confirmation, all the payment options accepted by us will be automatically suggested to you.
Failure to cancel an order or reject a cash on delivery shipment authorizes the suspension of our supplies. Further future supplies must be authorized by our administration office and must in any case be paid in advance before any delivery.
9-VAT exemptions and exports:
Goods intended for export to non-EEC countries are governed by the current regulations on the matter. The customer who wishes to benefit from the exemption from VAT payment must send us a copy of the declaration of intent before delivery of the goods.
Goods purchased directly by citizens or companies outside the EEC must be paid in advance by bank transfer or credit card.
10- Technical support, manuals, software and assistance on our products and orders:
Those who purchase directly from ProtoXide will enjoy dedicated professional technical-commercial support, which will allow them to be in direct contact with our staff and learn more about the purchased product. This support includes exclusive installation manuals and ProtoXide software that are exclusive to the direct buyer and the relative purchased product, for this reason you may be asked for the purchase invoice proving the actual purchase.
As a consequence of this, Protoxide will not be able to provide any type of assistance, installation manuals or technical support on material not purchased directly from ProtoXide, the same thing applies to material purchased for example as "used material or presumed to have been given as a gift or installed at the XXX Auto Repair Shop".
If the material was purchased from a Reseller, Tuner, workshop or representative of a forum, it will be the latter who informs you and possibly reports to you through our ProtoXide technical department, precisely because the relationship in place is unique and direct with the person who made the purchase and is the holder of the invoice. Therefore, we cannot provide any type of technical support, advice, replies to emails, installation manuals, order status information, photos or anything else, in the event that the order was not made directly to ProtoXide. This is to avoid having to often use double resources and easy misunderstandings, we cannot even respond to questions such as "I purchased through the XXX reseller, I would like to know what stage my order is at, or how to install the purchased control unit....etc", if the order was made through a reseller or preparer or forum, they themselves will report only to you. If you want to report to us, receive targeted technical answers, installation manuals or post-sales technical-commercial support, the only way is to BUY DIRECTLY YOU , through our multilingual shop, telephone orders, email orders and not through other intermediaries.
This Protoxide support in fact brings a notable added value to the purchased product , both when the installation of the same requires specialized technical information or especially when the usual product can also be found at other competitive retailers, but could have very different installations and use based on the desired applications, and only thanks to our suggestions matured from our experience, we can suggest the correct technical information for installation and use to obtain the best results and free from any initial and future problems.
11-Personal data:
The data provided by the customer for billing purposes are considered accurate, even if the computerized billing systems indicate any errors. The customer is required to verify them himself and promptly communicate any errors in the personal data. The customer is also required to promptly communicate in writing (mail or fax) any changes in personal data and the truthfulness of the data entered .
PROTOXIDE cannot be held responsible for any misunderstandings or inconveniences arising from the use of incorrect personal data provided by the customer.
Connections to the PROTOXIDE site do not take place through a secure connection (SSL), except for credit card transactions which are managed directly on a secure server by Setefi (Intesa Bank Group) .
PROTOXIDE assumes no responsibility for the data provided via the Internet (order form and quotation form) or by email.
12-Processing of personal data:
The processing of personal data occurs through manual, computerized and telematic means with the methods provided and in any case with all necessary precautions in order to guarantee the protection of the information and its confidentiality. Personal data is processed by PROTOXIDE for purposes related to its business and therefore to the issuing of documents and communications relating to commercial relationships.
According to article 13 of law 675/1996, the interested party has the right to know the existence of an archive containing his/her personal data, the use that PROTOXIDE makes of his/her data, the deletion of his/her data from the archives, except those necessary for legal and tax purposes and all those rights that law 675/1996 grants him/her.

13-Acceptance of the rules:
The issuance of an order or a request for a quote to PROTOXIDE , even if written, telephone or verbal, carried out by any means, implicitly indicates acceptance of all the conditions indicated on this page.

These conditions are complemented by the pages on our services, the materials we deal with and the price lists.
All brands handled by PROTOXIDE are the exclusive property of their respective owners.
The countries of origin, given the particular nature of the goods treated, are not identifiable unless clearly indicated on the materials themselves. PROTOXIDE assumes no responsibility for indications given by third parties.
